With the emergence of cross-border succession, the EU saw the need to simplify post-mortem situations in instances where one’s assets are spread across a number of jurisdictions. This led to the enactment of EU Regulation No. 650/2012, which aims to smoothen the procedure involved in cross-border succession by establishing one applicable law and one court to govern the whole estate.

The yachting industry is an essential part of Malta’s history and identity. A natural hub for the yachting and shipping industry, the Maltese registry is currently the largest in Europe and the sixth largest worldwide.

Furthermore, Daniela regularly advises yacht owners on VAT implications that arise in the case of yachts navigating in territorial waters of EU member states. In this regard, for the past 10 years, Malta applied a tried and tested mechanism whereby the effective VAT rate applicable in the case of certain yachts may be as low as 5.4% instead of the default 18%. The rule is that vessels owned by EU resident individuals or corporate entities have the right to free movement throughout the EU waters provided that VAT has been paid on the craft in any one of the 27 EU countries. In this regard, Malta developed what is known as the Malta VAT on Yacht Solution.
